Terms & Conditions

Last updated: 1 May 2026. Please read these Terms and Conditions carefully before using the Nosquito website or placing an order.

1. General Provisions

These Terms and Conditions (hereinafter: "Terms", "Agreement") constitute a legally binding agreement between you (hereinafter: "Customer", "User", "you") and Nosquito B.V. (hereinafter: "Nosquito", "we", "us", "our"), a company duly registered under the laws of the Netherlands, with its registered office in the Netherlands, reachable at hello@nosquito.com.

By accessing the website located at nosquito.com (hereinafter: "Website", "Platform") or by placing an order through any medium operated by Nosquito, you unconditionally accept and agree to be bound by these Terms in their entirety. If you do not agree with any provision contained herein, you must immediately cease all use of the Website and refrain from placing any order.

1.1 These Terms apply to all offers, agreements, orders, deliveries, and all other legal relationships between Nosquito and the Customer, to the exclusion of any general terms and conditions used by the Customer, unless expressly agreed otherwise in writing.

1.2 Nosquito reserves the right to amend these Terms at any time. Amended Terms shall take effect upon publication on the Website. Continued use of the Website following publication of amended Terms constitutes unconditional acceptance of those amendments.

1.3 The Website and its contents are intended solely for persons aged 18 (eighteen) years or older. By using the Website or placing an order, you represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into binding agreements. Nosquito expressly disclaims any liability for use of the Website by persons under the age of 18.

1.4 These Terms are governed by Dutch law. Where mandatory consumer protection legislation of another EU Member State affords the Customer greater protection, such mandatory provisions shall not be excluded by these Terms.

2. Products and Services

2.1 Nosquito offers for sale a range of UV-C and ultrasonic insect and tick protection devices and related accessories (hereinafter collectively: "Products"). The Products are designed for indoor and outdoor use in residential and non-industrial settings and are not intended as professional pest control equipment.

2.2 All product descriptions, technical specifications, dimensions, weights, coverage areas, and performance data published on the Website are provided in good faith and to the best of Nosquito's knowledge at the time of publication. Nosquito reserves the right to alter product specifications, packaging, components, and ancillary materials at any time without prior notice, provided that any such alteration does not materially impair the core functionality of the Product.

2.3 Product images, including photographs and computer-generated renders, are provided for illustrative purposes only and may not precisely represent the final product delivered to the Customer. Minor variations in colour, finish, or texture as a result of display calibration or manufacturing tolerances shall not constitute a basis for a claim or return.

2.4 Availability of Products on the Website is not guaranteed. Nosquito reserves the right to discontinue any Product at any time without notice and to limit quantities available for purchase per Customer.

3. Ordering Process

3.1 By placing an order on the Website, the Customer makes an offer to purchase the selected Product(s) subject to these Terms. An order confirmation email does not constitute acceptance of the Customer's offer; acceptance occurs only upon dispatch of the Products or explicit written confirmation by Nosquito.

3.2 Nosquito reserves the unilateral right to cancel or refuse any order, in whole or in part, at its sole discretion, including but not limited to cases where: (a) the Product is out of stock or discontinued; (b) a pricing error has occurred on the Website; (c) the Customer's payment cannot be verified or authorised; (d) the order appears to be fraudulent or in breach of these Terms; or (e) the order quantity exceeds reasonable consumer limits. In the event of cancellation prior to dispatch, any payment received shall be refunded in full within fourteen (14) calendar days.

3.3 In the event of a manifest pricing error on the Website (including but not limited to a price of zero or a price that is obviously below market value), Nosquito shall not be bound to honour such price and may, at its election, either: (a) contact the Customer to offer the Product at the correct price; or (b) cancel the order and issue a full refund.

3.4 The Customer is solely responsible for ensuring that all information provided during the ordering process, including but not limited to delivery address, contact details, and payment information, is accurate, complete, and up to date. Nosquito shall bear no liability for failed or delayed delivery resulting from inaccurate Customer-supplied information.

4. Pricing and Currency

4.1 All prices displayed on the Website include applicable value-added tax (VAT/BTW) at the rate applicable in the Netherlands, unless expressly stated otherwise. Where delivery is made to a destination outside the European Union, prices shown may be exclusive of applicable import duties, customs fees, and local taxes, all of which are the sole responsibility of the Customer.

4.2 Prices are displayed in Euros (EUR) by default. Where a currency selector is available on the Website, displayed prices in other currencies are indicative only and calculated using third-party exchange rate data. The Customer's payment provider may apply a different exchange rate and additional foreign currency transaction fees, for which Nosquito bears no responsibility.

4.3 Nosquito reserves the right to amend prices at any time without prior notice. The price applicable to any given order shall be the price displayed on the Website at the time the Customer completes the checkout process, subject to Section 3.3 above (manifest pricing errors).

4.4 Promotional prices, discount codes, and sale prices are valid for the period and under the conditions specified and may be withdrawn at any time prior to the Customer completing a transaction at the discounted price. Discount codes are non-transferable, cannot be combined unless expressly stated, and are subject to individual usage limits.

5. Payment Processing

5.1 Payment for all orders must be made at the time of purchase. Nosquito accepts payment through the methods displayed at checkout, which may include credit card, debit card, and other payment methods facilitated by third-party payment service providers including but not limited to Stripe, Inc. (hereinafter: "Payment Processor").

5.2 All payment transactions are processed exclusively by the Payment Processor. Nosquito does not receive, store, handle, or have access to the Customer's full payment card details. All card data is transmitted directly to and stored by the Payment Processor in accordance with Payment Card Industry Data Security Standards (PCI-DSS). By providing payment information, the Customer authorises the charge to the specified payment method for the total order amount.

5.3 All data transmitted between the Customer's device and the Website, including payment information, is encrypted using Secure Sockets Layer (SSL) / Transport Layer Security (TLS) technology. Nosquito employs commercially reasonable technical and organisational security measures to protect the Website and the Customer's data; however, no method of electronic transmission is entirely secure, and Nosquito cannot guarantee absolute security.

5.4 In the event that a payment is declined, the order shall not be processed and Nosquito bears no obligation to reserve the Product(s) selected. The Customer must resolve any payment failure directly with their payment provider. Nosquito bears no liability for losses arising from payment failure.

5.5 Chargebacks and payment disputes must be initiated through the Customer's payment provider. Nosquito reserves the right to contest chargebacks where it considers the chargeback to be without legal basis. Where a chargeback is upheld, Nosquito reserves the right to recover any goods shipped to the Customer and to suspend the Customer's access to the Website.

6. Order Fulfilment and Shipping

6.1 Nosquito operates a fulfilment model pursuant to which orders are fulfilled by third-party supplier partners (hereinafter: "Suppliers"). By placing an order, the Customer acknowledges and accepts that the Product may be dispatched directly from a Supplier's warehouse, which may be located outside the Netherlands or outside the European Union.

6.2 Estimated delivery times are provided for indicative purposes only and shall not constitute a guarantee or contractual commitment. Standard estimated delivery times are five (5) to fifteen (15) business days from the date of order confirmation, subject to customs clearance, carrier delays, and force majeure events. Nosquito shall not be liable for delays caused by third-party carriers, customs authorities, or circumstances beyond its reasonable control.

6.3 Where available, the Customer will be provided with a tracking number upon dispatch. Nosquito cannot guarantee the accuracy or continuous availability of third-party carrier tracking systems.

6.4 For deliveries to destinations outside the European Union, the Customer is solely responsible for all import duties, customs fees, taxes, and any other charges imposed by the destination country. Nosquito makes no representations regarding the admissibility of Products into any particular jurisdiction. If a delivery is refused by customs or returned due to failure to pay applicable duties, Nosquito reserves the right to deduct actual shipping and handling costs from any refund issued.

6.5 Risk of loss and title to the Products shall pass to the Customer upon delivery to the address specified in the order.

7. Returns and Cancellations

7.1 Subject to the conditions set out in this Section, the Customer has the right to return a Product within thirty (30) calendar days from the date of delivery (hereinafter: "Return Window").

7.2 In order to be eligible for a return and refund, the Product must satisfy all of the following conditions without exception: (a) the Product must be in its original, unused, and unaltered condition; (b) the Product must be returned in its original, undamaged packaging, including all accessories, documentation, and components as originally supplied; and (c) the return request must be initiated by contacting Nosquito at hello@nosquito.com within the Return Window, providing the order number and reason for return.

7.3 THE CUSTOMER IS SOLELY AND EXCLUSIVELY RESPONSIBLE FOR ALL COSTS ASSOCIATED WITH RETURNING THE PRODUCT, INCLUDING BUT NOT LIMITED TO RETURN SHIPPING FEES, CUSTOMS DUTIES, AND INSURANCE. NOSQUITO DOES NOT PROVIDE PREPAID RETURN LABELS UNDER ANY CIRCUMSTANCES. Nosquito shall not be responsible for Products lost or damaged in transit during a return shipment.

7.4 Upon receipt of the returned Product, Nosquito will inspect it within a reasonable period. If the returned Product satisfies the conditions in Section 7.2, Nosquito will issue a refund of the original purchase price within fourteen (14) calendar days of confirming receipt of the qualifying return. Refunds will be issued to the original payment method.

7.5 Products returned showing signs of use, damage, modification, missing components, or returned in packaging other than the original packaging may, at Nosquito's sole discretion, be (a) refused and returned to the Customer at the Customer's cost; or (b) subject to a restocking and handling fee of up to twenty-five percent (25%) of the original purchase price, deducted from the refund amount.

7.6 For consumers within the European Union, the statutory right of withdrawal under applicable EU consumer protection law is not excluded by these Terms. Where mandatory EU or national consumer rights afford the Customer a broader right of return than provided herein, such mandatory rights shall prevail.

8. Defective and Damaged Products

8.1 All claims relating to Products that are defective upon delivery or damaged during transit must be submitted to Nosquito in writing at hello@nosquito.com within forty-eight (48) hours of the date of delivery. Claims submitted after this period may, at Nosquito's sole discretion, be declined.

8.2 To support a claim under this Section, the Customer must provide: (a) the order number; (b) a clear written description of the defect or damage; and (c) photographic evidence of the defective or damaged Product and, where relevant, photographic evidence of the packaging as received.

8.3 Nosquito reserves the unilateral right to elect, in its sole discretion, whether to remedy a valid claim under this Section by: (a) providing a replacement product; or (b) issuing a full or partial refund. Nosquito shall not be obliged to offer both remedies simultaneously.

9. Warranty

9.1 All Products sold by Nosquito are covered by a limited manufacturer's warranty of twenty-four (24) months from the date of original purchase, against defects in materials and workmanship under normal use conditions (hereinafter: "Warranty").

9.2 The Warranty is strictly limited to repair or replacement of the defective Product, at Nosquito's sole election, and does not extend to: (a) any consequential, incidental, indirect, special, or punitive damages; (b) loss of profits, revenue, data, or goodwill; (c) costs of substitute products or services; or (d) any other loss or damage not directly arising from the manufacturing defect.

9.3 The Warranty shall be void and of no effect if: (a) the Product has been modified, disassembled, or repaired by any person other than Nosquito or a Nosquito-authorised service provider; (b) the Product has been subjected to misuse, abuse, negligence, accident, or operation in a manner inconsistent with its intended use or the instructions provided; (c) the Product has been exposed to abnormal environmental conditions, including but not limited to excessive moisture, voltage surges, or mechanical shock; or (d) the serial number or warranty label has been removed, altered, or defaced.

9.4 UV-C lamps and consumable components are excluded from Warranty coverage and are subject to normal wear and replacement cycles as described in the product documentation.

10. Product Safety and Limitation of Liability

10.1 Nosquito's Products have been designed and tested in accordance with applicable European safety standards, including EU EN 62471 (photobiological safety of lamps and lamp systems). Customers should follow all usage instructions provided with the Product.

10.2 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOSQUITO EXPRESSLY EXCLUDES ALL LIABILITY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE PURCHASE OR USE OF THE PRODUCTS, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, HOWSOEVER CAUSED AND WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF NOSQUITO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10.3 In no event shall Nosquito's total aggregate liability to the Customer in connection with any single order exceed the total purchase price actually paid by the Customer for the Product(s) giving rise to the claim, exclusive of shipping costs.

10.4 The Customer assumes all risk associated with use of the Product beyond its stated technical specifications. No liability shall attach to Nosquito for losses arising from improper use, installation contrary to the provided instructions, or use in environments for which the Product was not designed.

10.5 Nothing in these Terms shall operate to limit or exclude liability for: (a) death or personal injury caused by Nosquito's negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot lawfully be excluded.

11. Data Collection and Processing

11.1 By using the Website and placing an order, the Customer consents to the collection and processing of personal data as described in Nosquito's Privacy Policy, available on the Website and incorporated herein by reference.

11.2 The categories of personal data collected by or on behalf of Nosquito include, but are not limited to: full name, delivery and billing address, email address, telephone number, payment information (processed and tokenised by third-party payment processors; raw card data is not stored by Nosquito), IP address, device identifiers and browser information, browsing behaviour and interaction data on the Website, purchase history, newsletter preferences, and cookie identifiers.

11.3 Personal data is processed for the following purposes: (a) processing and fulfilling orders; (b) managing customer accounts and enquiries; (c) preventing and detecting fraud; (d) communicating with the Customer regarding orders, returns, and warranty matters; (e) sending marketing communications, subject to the Customer's consent where required; (f) improving and personalising the Website experience; and (g) compliance with applicable legal and regulatory obligations.

11.4 Personal data may be shared with authorised third-party service providers acting as data processors, including payment processors, logistics and fulfilment partners, email marketing platforms, and analytics providers, solely to the extent necessary for the performance of the above-stated purposes and subject to appropriate data processing agreements.

12. Cookies and Tracking Technologies

12.1 The Website uses cookies, pixel tags, web beacons, and similar tracking technologies (hereinafter collectively: "Cookies") for the purposes of: (a) ensuring basic website functionality (strictly necessary Cookies); (b) remembering Customer preferences (functional Cookies); (c) analysing Website traffic and user behaviour (analytics Cookies); and (d) serving personalised advertising (marketing Cookies).

12.2 Strictly necessary Cookies are placed without the requirement for consent. Functional, analytics, and marketing Cookies are placed only where the Customer has provided valid consent through the Cookie consent mechanism on the Website. The Customer may withdraw consent or manage Cookie preferences at any time through the Cookie settings panel.

12.3 Full details of the Cookies used on the Website, their purpose, duration, and the third parties with whom data may be shared are set out in Nosquito's Cookie Policy, available on the Website. Continued use of the Website following the presentation of the Cookie consent banner constitutes acceptance of strictly necessary Cookies.

13. Intellectual Property

13.1 All content published on or accessible through the Website, including but not limited to text, graphics, photographs, illustrations, video content, audio content, software, source code, data compilations, product names, brand names, logos, trade marks, and trade dress (hereinafter collectively: "Intellectual Property"), is the exclusive property of Nosquito or its licensors and is protected by applicable intellectual property laws, including copyright, trade mark, and design rights.

13.2 No portion of the Intellectual Property may be reproduced, copied, adapted, modified, translated, distributed, transmitted, publicly displayed, published, or otherwise exploited for any commercial or non-commercial purpose without the prior express written permission of Nosquito.

13.3 The Customer is granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Website solely for the purpose of browsing and purchasing Products for personal use. This licence does not permit scraping, data harvesting, or any automated or systematic extraction of data from the Website.

14. Governing Law and Jurisdiction

14.1 These Terms and all disputes, claims, or matters arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed exclusively in accordance with the laws of the Netherlands, without regard to its conflict of laws provisions.

14.2 Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be submitted to the exclusive jurisdiction of the competent courts of the Netherlands, unless the Customer is a consumer habitually resident in another EU Member State, in which case the Customer may also bring proceedings in the courts of their habitual residence.

14.3 Nothing in this Section shall affect any mandatory rights that the Customer may have as a consumer under applicable EU or national consumer protection legislation, including the right to access out-of-court dispute resolution mechanisms. For EU consumers, information about online dispute resolution is available at the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

15. Force Majeure

15.1 Nosquito shall not be liable for any failure or delay in performance of its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond Nosquito's reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, wars, civil unrest, acts of terrorism, governmental actions, embargoes, strikes or industrial disputes (whether or not involving Nosquito's employees), failures of third-party service providers (including carriers, payment processors, and suppliers), and interruptions to power or telecommunications infrastructure.

15.2 In the event of a force majeure event, Nosquito shall notify the Customer as soon as reasonably practicable and shall use commercially reasonable efforts to mitigate the effect of the event. If the force majeure event continues for a period exceeding sixty (60) calendar days, either party may terminate the affected order upon written notice, and Nosquito shall refund any payment received for undelivered Products.

16. Amendments to These Terms

16.1 Nosquito reserves the absolute right to modify, update, revise, supplement, or otherwise amend these Terms at any time and without prior notice to the Customer, except where a longer notice period is required by applicable law.

16.2 Amended Terms shall be published on the Website with a revised "Last Updated" date. It is the Customer's responsibility to review these Terms periodically. Continued use of the Website or placement of an order following publication of amended Terms shall constitute the Customer's unconditional acceptance of the amended Terms in their entirety.

16.3 Where an amendment materially affects the Customer's rights under an order that has already been placed and accepted by Nosquito, the version of the Terms in force at the time of order acceptance shall govern that specific order.
